Delhi HC Denies Bail to Former AAP MLA Naresh Balyan in MCOCA Case

MCOCA Bail Rejection Case

The Delhi High Court on Monday rejected the bail application of former Aam Aadmi Party (AAP) MLA Naresh Balyan in a case registered under the Maharashtra Control of Organised Crime Act, 1999 (MCOCA).

Justice Manoj Jain passed the order refusing bail. Detailed reasons for the decision are awaited.

Balyan was arrested by the Delhi Police Crime Branch on 4 December 2024. The prosecution alleges that he maintained links with an organised crime syndicate allegedly headed by absconding gangster Kapil Sangwan alias Nandu.

The allegations against Balyan are based, inter alia, on an audio recording purportedly containing a conversation between him and the alleged gangster. The prosecution claims the material establishes his association with the organised crime syndicate, attracting the provisions of the MCOCA.
