The Delhi High Court has granted an ex parte ad interim injunction in favour of Skechers in an intellectual property enforcement action concerning alleged imitation of its “Go Walk 5” footwear series.
Taking note of allegations of design infringement, trade dress violation and likelihood of consumer confusion, the Court restrained the defendant and all persons acting on its behalf from manufacturing, marketing, importing, selling or advertising products bearing the impugned designs.
To assess the extent of infringement and prevent further circulation of counterfeit products, the Court also appointed Local Commissioners to conduct search and seizure operations across multiple locations linked to the defendant.
Pursuant to the Court’s directions, coordinated enforcement action was carried out across three locations within a single day, aimed at securing evidence and curbing ongoing infringement.
The matter was led by the Partners Nandan Pendsey, Dr. Abhimanyu Chopra and Priyanka Shetty, Senior Associate Ayush Chaddha and Associate Kushagra Jain.
