‘Court Can’t be Mute Spectator’: Delhi HC Stays NEET-Super Speciality 2025 Counselling Process

Vinay Kumar & Anr. v. National Board of Examinations in Medical Sciences (NBEMS) & Ors., W.P.(C) No. 12265/2026 [Order dated August 21, 2026]

Delhi HC NEET SS Counselling

The Delhi High Court has stayed the NEET-Super Speciality (NEET-SS) 2025 counselling process after two doctors approached the Court challenging the withdrawal of their seat allotments. Justice Jasmeet Singh passed the interim order staying the entire counselling process while remarking that “this Court can’t be a mute spectator.”

The petitioners, who secured All India Ranks 286 and 267 respectively in the Medical Oncology group, had been allotted DNBSS Medical Oncology at Max Super Speciality Hospital, Mohali, during Round 2 of counselling based on their merit and choices.

However, the NBEMS subsequently withdrew the allotments on August 17, citing an issue relating to the minimum accreditation criteria of the concerned department. The doctors contended that there was no fault, ineligibility, misconduct or default on their part and that they should not be made to suffer on account of an institutional issue beyond their control.

The Round 2 reporting process was scheduled to conclude at 6 PM on August 21. Considering the urgency and the issues raised by the petitioners, the High Court stayed the counselling process.
