Delhi High Court Defers Hearing In Irfan Pathan’s Plea Against Bail Cancellation After Parties Enter Fresh Settlement

The Delhi High Court on Monday deferred hearing in former cricketer Irfan Pathan’s plea challenging cancellation of his bail after being informed that the parties had entered into a fresh settlement agreement aimed at resolving the underlying dispute.

Justice Prateek Jalan was hearing the matter, in which Senior Advocate Rebecca John and Advocate Prateek Som engaged in extensive arguments over the legal sustainability of the bail cancellation and the effect of prior failed settlements.

During the hearing, it was submitted that this was the third settlement between the parties, with the previous settlement having allegedly been breached, leading to cancellation of bail. Rebecca John Sr. Advocate pressing the plea questioned the legal basis for cancellation of bail solely on the ground of non-compliance with monetary or settlement-linked conditions, while also citing precedent on the issue.

The Court was informed that the parties had now executed a fresh and more comprehensive settlement agreement, which contemplates transfer of immovable property, in favour of the complainants, along with staggered monetary payments. It was also submitted that the first portion of the settlement amount approximately ₹76.82 lakh had already been paid, with further payments and registration of the properties to follow within the agreed timelines.

Given the fresh settlement, the petitioner sought time to demonstrate compliance, particularly with respect to execution and registration of the property transfer. The Court accordingly deferred further consideration, indicating that compliance with the new arrangement could be reviewed on the next date of hearing.
