Delhi HC Orders Takedown of Deepfake Content Using Bhuvan Bam’s Identity; Grants Interim Relief

The Delhi High Court, in a commercial suit filed by Bhuvan Bam and another, has granted an ex parte ad interim injunction restraining continued digital infringement of the plaintiffs’ personality and intellectual property rights. The order was passed by Justice Jyoti Singh.

The plaintiffs approached the Court alleging widespread unauthorized use of Bhuvan Bam’s name, image, voice, and characters associated with BB Ki Vines, including circulation of deepfake content and sale of infringing merchandise across various online platforms. The Court noted that despite an earlier injunction dated 13.01.2026 restraining certain defendants, fresh instances of infringement had surfaced, necessitating further directions.

Upon examining the material on record, including screenshots and online listings, the Court held that the plaintiffs had established a prima facie case, with the balance of convenience in their favour, and that failure to grant protection would result in irreparable harm, not only to the plaintiffs but also to unsuspecting members of the public.

Accordingly, the Court restrained unknown defendants (John Doe) from creating, publishing, or disseminating any content infringing the plaintiffs’ personality/publicity rights or trademarks. It also issued specific takedown directions to multiple intermediaries and platforms, including Google LLC (YouTube); Flipkart, Spotify India, Meta Platforms Inc. and Other online sellers such as BeeTrendy and Swag Shirts.

These entities were directed to remove specified infringing URLs within 36 hours and file compliance affidavits thereafter.

The Court also took note of objections raised by some defendants claiming that certain content fell within the realm of parody or caricature, observing that the issue would be examined at a later stage after hearing all parties.

Additionally, the Court allowed impleadment of several online platforms as defendants and permitted amendment of the plaint to incorporate subsequent instances of infringement, reinforcing the dynamic nature of the injunction in tackling evolving digital violations.

The matter is now listed for further hearing, with directions for filing written statements and completion of pleadings.
