Delhi High Court Continues Bar on Further Appointments to NAREDCO Governing Council Pending Hearing of Election Dispute

Delhi HC NAREDCO election dispute

The Delhi High Court continued the interim restriction on further appointments to the Governing Council of NAREDCO (National Real Estate Development Council) while hearing a suit challenging the election process adopted during its 138th Governing Council Meeting.

Justice Mini Pushkarna was dealing with a civil suit filed by Ravula Venkateswara Rao and others against the Union of India, NAREDCO and its office-bearers. The matter was taken up pursuant to an earlier order passed by a Division Bench directing that no further Governing Council members shall be appointed till disposal of the injunction application.

The plaintiffs have challenged the appointments of Dr. Niranjan Hiranandani as Chairman, Praveen Jain as President and Rajan Bandelkar as Vice Chairman of NAREDCO, contending that the appointments were made without following the prescribed election process under the organisation’s Rules and Regulations.

The suit alleges that the appointments were “illegal, arbitrary and unconstitutional” and contrary to the agenda circulated for the meeting, which specifically included election of office-bearers.

The Court granted liberty to the plaintiffs to file rejoinder to the reply filed in the injunction application and also permitted filing of replication to the written statement submitted by defendant nos. 2 to 5 after it was pointed out that the earlier copy supplied did not contain complete documents.

The Court clarified that the timeline for filing replication would commence from April 30, 2026, when the complete set of documents was furnished before the Court.

Separately, the Court allowed an impleadment application under Order I Rule 10 CPC and permitted the applicant to be added as defendant no. 7 in the suit. Delay in re-filing the application was also condoned.

The matter has now been listed for hearing of the interim injunction application on May 25, 2026.
