The Delhi High Court on Tuesday issued notice on a writ petition filed by a woman seeking directions to preserve and continue the IVF process after her husband allegedly withdrew his consent, leaving her with what she claims is her last opportunity to conceive.
The matter came up before a Division Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia.
According to the petitioner, she and her husband had jointly undergone the IVF process. However, following matrimonial disputes, the husband withdrew his consent, prompting the IVF clinic to propose destruction of the embryos in accordance with the applicable regulatory framework.
Advocate Bharat Chugh, Counsel for petitioner contended that, owing to her medical condition and advancing age, the embryos represent her last realistic chance of biological motherhood. She sought directions restraining the clinic from destroying the embryos pending adjudication of the writ petition. After hearing the submissions, the Bench issued notice to the respondents.
