In a criminal writ petition filed before the Delhi High Court seeking quashing of an order dated 16-01-2026 by the competent authority, as well as the grant of parole for two months, a Single Judge Bench of Justice Girish Kathpalia granted parole to the petitioner, setting aside the impugned order.
The petitioner was convicted of murder after rape and was sentenced to life imprisonment. After spending 17 years in jail, the petitioner sought parole to repair his house and maintain social ties. The parole application was rejected by the competent authority, stating that, upon checking, his house did not require any immediate repairs. The Court concurred with this finding after perusing a picture of the petitioner’s house.
The petitioner referred to Rule 1208(vii) of the Delhi Prison Rules and asserted that his main ground for seeking parole was to maintain social ties.
Hence, the Court set aside the impugned order to the extent that it did not consider the petitioner’s necessity to maintain social ties and allowed the petition directing the petitioner to be released on parole for four weeks, subject to his furnishing a personal bond of Rs. 10,000/- with a surety of like amount.
