Delhi High Court Allows Saurav Das, Ashutosh Ranka to Withdraw Plea Challenging Judicial Custody

Delhi High Court Preventive Detention

The Delhi High Court permitted Saurav Das and Ashutosh Ranka to withdraw their petition challenging the proceedings initiated against them under the preventive provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS), after suggesting that they pursue remedies available in law.

Justice Subramonium Prasad clarified that it had not expressed any opinion on the merits of the case.

During the hearing, Advocate Abhik Chimni, appearing for the petitioners, urged the Court to ensure that the respondents filed a reply to the application already pending before the Court. He referred to an earlier order recording that the respondents did not wish to file a reply, while also directing them to place their written submissions on record within two days.

Abhik Chimni submitted that the petitioners had previously furnished fresh sureties, but their execution had allegedly not been properly considered. He also raised concerns regarding the manner in which the bonds were being processed and the possibility of further preventive custody.

After the Court indicated that the petitioners could withdraw the plea and pursue remedies in accordance with law, Chimni accepted the suggestion. He requested that the respondents be directed to file their reply to the pending application.

Additional Solicitor General Chetan Sharma also made submissions referring to the earlier order and the respondents’ stand on filing a reply.

The Court’s final order clarified that the petitioners’ withdrawal would not amount to an adjudication on the merits, with all contentions left open.
