In a bail application filed before the Madhya Pradesh High Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) regarding a First Information Report (FIR) registered under Sections 318(4), 319(2), 338, 336(3), 340(2) of the Bharatiya Nyaya Sanhita, 2023 (BNS), and Section 66D of the Information Technology Act, 2000, a Single Judge Bench of Justice Gajendra Singh granted conditional bail to the applicant considering that the co-accused persons had been released on bail.
A retired government school principal (complainant), was subjected to a cyber fraud on 24-06-2-25 by unknown persons impersonating police and CBI officials, who, by inducing fear of involvement in a money laundering case and by placing him under so-called ‘digital arrest’, compelled him to transfer approximately Rs. 20,81,382/- through RTGS transactions on 25-06-2025 and 26-06-2025 into various bank accounts provided by the accused persons.
Allegedly, Rs. 21,000/- had been seized from the applicant, who had been in custody since 30-07-2025 and his first bail application had been dismissed on merits by an order dated 14-10-2025. The present application was preferred on the ground that by an order dated 18-11-2025, charges had been framed against the applicant and the co-accused had been released on bail.
Considering the circumstances, the Court allowed the present application subject to a deposit of Rs. 2,50,000/- each by the applicants or any person on their behalf, out of which Rs. 1,00,000/- was directed to be deposited before the applicant’s release, i.e., at the time of furnishing the bail bond. The remaining amount was to be deposited in three equal instalments of Rs. 50,000/- within three months from the date of the applicant’s release. The Court stated that the said amount would be subject to the final outcome of the case by the trial court.
Further, the Court directed the applicants to be released on bail upon furnishing a bond of Rs. 25,000/- each with one surety of a like amount and for an application of cancellation to be filed before the trial court in the event that any applicant violates the terms of the present order. Thus, the application was disposed of.
