Yogesh Hemnani v. State of Madhya Pradesh & Ors. [Decided on 16-04-2026]

vande mataram refusal legal issue

A writ petition was filed before the Madhya Pradesh High Court as a Public Interest Litigation (PIL), wherein it was alleged that Councillors of the Municipal Corporation, Indore (respondents 5 and 6) had refused to recite the national song ‘Vande Mataram’.

The petitioner contended that the conduct of the respondents was violative of Article 51A(a) of the Constitution, and that it was punishable under the Prevention of Insult to National Honour Act, 1971.

Accordingly, a Division Bench of Justice Vijay Kumar Shukla and Justice Alok Awasthi issued notice to the respondents. The Court also issued notice to respondents 5 and 6 regarding payment of PF within 3 working days.

The matter has now been listed in the week commencing 11-05-2026.
