The Supreme Court on Monday granted liberty to parties to explore an amicable resolution in a dispute concerning alleged demolition action against a Gurudwara in Colaba, Mumbai. The petitioner alleged that despite a subsisting order of the Supreme Court restraining demolitions without due process, authorities had proceeded to demolish the structure without notice. Counsel submitted before the Bench:
“At that time there was an order operating of this honourable court which has finally resulted in a final judgement… that no demolitions will be done throughout the country. During that period… they have without notice come and demolished.”
During the hearing, senior advocate Kapil Sibal, appearing in the matter, sought that the dispute be resolved mutually while submitting that “There are so many other projects… we don’t want to spoil our relationship at the same time this is not something that is insurmountable.”
Responding to the it, the Court observed: “If you are able to resolve, we will be the most happy.”
The matter was thereafter adjourned till after the summer vacation. Recording that arguments heard in part, the Bench directed the matter to be listed on July 21 for further directions.
