Supreme Court Grants Bail to NDPS Accused Juvenile for Illegally Possessing 45 kgs of Ganja after Denial from Chhattisgarh HC

In a petition filed before the Supreme Court against a judgment and order dated 12-03-2026 by the High Court of Chhattisgarh, a Bench comprising Justice K.V. Viswanathan and Justice Vijay Bishnoi granted bail to the petitioner subject to the Juvenile Justice Board’s satisfaction.

The petitioner, a juvenile in conflict with law, was the son of a servant lady employed in the house of one of the accused persons, who was confined in the observation home. The juvenile was found with two other persons in a vehicle containing 45 kgs of ganja, having a value of Rs. 6,75,000/-.

The Court perused the order of the Juvenile Board and found no objective assessment of the parameters required under the proviso to Section 12 of the Juvenile Justice Act, 2015 (JJ Act). The impugned judgment of the High Court was also perused by the Court, but the Court was not satisfied with the reasons given for the denial of bail.

The Court was satisfied that a case was made out for enlarging the petitioner on bail, even after applying the parameters under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). Thus, the petitioner was directed to be released on bail, subject to the Juvenile Justice Board’s satisfaction.
