The Supreme Court has issued significant directions to address systemic delays in filing appeals and Special Leave Petitions in legal aid matters, making prescribed timelines for processing such cases binding on legal services authorities and related stakeholders.

The Court was dealing with a long-pending matter concerning delays in legal aid petitions filed through the Supreme Court Legal Services Committee (SCLSC), particularly in cases involving convicts. Taking note of persistent procedural delays, the Court considered a comprehensive Standard Operating Procedure (SOP) formulated after extensive consultations with stakeholders including NALSA, High Courts, and legal services authorities.

Endorsing the SOP, the Court held that while its broader implementation would be subject to consideration by High Courts on the administrative side, the timelines prescribed under the SOP shall be binding, with a view to streamlining the filing of appeals and addressing structural deficiencies in the legal aid system.

The SOP establishes a structured framework governing the entire lifecycle of legal aid cases—from pronouncement of judgment to filing before appellate courts—by prescribing stage-wise responsibilities and strict timelines for trial courts, legal services authorities, jail authorities, and panel lawyers. It also categorises cases based on priority, mandates prompt translation of records, and provides for digitisation and real-time tracking of case progress.

Emphasising the constitutional underpinning of legal aid, the Court reiterated that access to justice is not merely a policy objective but a fundamental component of fair procedure under Article 21, read with Article 39A, which obligates the State to ensure that no person is denied justice due to economic or other disabilities.

To strengthen accountability, the Court directed constitution of Monitoring Committees at the Supreme Court and High Court levels to oversee compliance with timelines, review delays, and evaluate performance of stakeholders. It further mandated incorporation of a standardised delay-explanation format in all legal aid appeals to ensure transparency in condonation of delay.

The Court also directed the development of a unified digital platform, to be facilitated by the National Informatics Centre, for seamless coordination between legal services authorities, courts, and prison authorities, enabling real-time exchange of records and status tracking.

Recognising translation of vernacular records as a key bottleneck, the Court called upon High Courts to examine and strengthen the cadre of translators and translation supervisors within a time-bound framework.
