The Supreme Court has directed the Union Government to obtain written reports from all States and Union Territories on the steps taken to implement its judgment recognising menstrual hygiene and menstrual health as facets of the fundamental right to life under Article 21 of the Constitution. The Court warned that it may issue contempt notices to the concerned Chief Secretaries if any State or Union Territory fails to respond.
A Bench of Justice J.B. Pardiwala and Justice R. Mahadevan noted that despite the Union Government taking up the matter seriously and seeking responses from the States and Union Territories, they had not yet provided the required information.
Emphasising the importance of effective implementation, the Court observed that its judgment must not remain ‘only on paper’. It highlighted the impact of inadequate menstrual hygiene on young girls, particularly in remote parts of the country, where menstrual health-related difficulties can lead to girls discontinuing their education.
The Court directed the Union Government to revisit its judgment dated September 1, 2026, and seek information on every aspect of its implementation, with particular attention to paragraphs 11 and 13 to 23 of the order. It also permitted the Centre to prepare a questionnaire to obtain structured responses from the States and Union Territories.
Granting one final opportunity to comply, the Court listed the matter for further hearing on December 14, 2026, and cautioned that contempt proceedings may follow against the Chief Secretaries of non-compliant States
