The Supreme Court issued notice in the bail matter of AAP MLA Naresh Balyan, with the Additional Solicitor General accepting notice on behalf of the respondent and four weeks’ time being granted to file a counter-affidavit.
The Supreme Court on Monday issued notice on the fresh bail plea of AAP MLA Naresh Balyan in the case registered against him under the Maharashtra Control of Organised Crime Act, 1999 (MCOCA). Additional Solicitor General accepted notice on behalf of the respondent and four weeks’ time was granted to file a counter-affidavit.
The Bench candidly remarked that the matter would be dismissed on the next date. Senior Advocate Abhishek Manu Singhvi responded hopefully and pointed out that a similar SLP had already been dismissed on October 9. Counsel also submitted that there were 17 FIRs mentioned in the matter, though he had not named any of them. The Bench then observed:

“This is a very strange thing which happens only in Supreme Court. In High Court, we would not touch a second application unless there was a material change in circumstances.”
Counsel clarified that the present request was for an early hearing and not a second dismissal.
The matter arises from an FIR registered by the Delhi Police Crime Branch under Sections 3 and 4 of MCOCA in connection with an alleged organised crime syndicate headed by Kapil Sangwan @ Nandu. Balyan, who was arrested on December 4, 2024, is alleged by the prosecution to have been associated with and facilitated the activities of the syndicate. The Delhi High Court on August 3, 2026 rejected his bail plea, finding prima facie material to sustain the invocation of MCOCA.
