The Supreme Court on Friday sought original records from Maharashtra State Mining Corporation Limited (MSMCL) while hearing a plea challenging a Madhya Pradesh High Court order dismissing a review petition over alleged misstatements in an affidavit.
A Bench led by the Chief Justice of India was hearing submissions concerning an alleged discrepancy in a document dated June 14, 2024, which the petitioners claimed contained an inserted paragraph relating to shifting of a washery.
During the hearing, Sr Adv Shyam Diwan submitted that the controversy centred around a single paragraph in the document and urged the Court to call for records directly from MSMCL to verify the authenticity of the communication.
The Bench agreed to examine the original records and directed MSMCL to produce the relevant documents, including electronic records and the original application referred to by the parties.
The Court was also informed that the alleged discrepancy regarding dates in the affidavit was a “bona fide mistake” arising from confusion between the preparation date and notarisation date of the document. Counsel argued that the affidavit had in fact been served on the opposite side and uploaded before the High Court hearing.
Observing that the issue could be resolved upon production of the original records, the Bench posted the matter for further hearing next Friday.
