A Public Interest Litigation (PIL) has been filed before the Supreme Court under Article 32 of the Constitution seeking effective implementation of the constitutional framework governing urban local self-governance in Scheduled Areas. The petition raises concerns over the alleged absence of an effective municipal governance mechanism in Fifth Schedule areas and seeks enforcement of Article 243ZC read with the Fifth Schedule to ensure democratic representation, participatory governance, and protection of the constitutional rights of Scheduled Tribes and other residents.
Filed by Rajkumar Roat, Member of Parliament (Lok Sabha) from Rajasthan, the petition contends that the existing governance vacuum has resulted in inadequate implementation of the constitutional scheme envisaged for Scheduled Areas. It seeks appropriate directions from the Supreme Court to ensure compliance with the constitutional provisions governing urban local bodies in these regions.
