Supreme Court Declines Intervention in Hathras Rape & Murder Case Pending Consideration in HC

The Supreme Court today has declined to intervene in a petition arising from the Hathras rape & Murder case, noting that the issues raised were already under active consideration before the High Court.

During the hearing, the bench of Justice P. S. Narasimha and Justice Alok Aradhe questioned the maintainability of parallel proceedings when the matter remained pending before the High Court. The petitioner’s counsel argued that key reliefs, including relocation of the victim’s family, had been rejected, while the State submitted that subsequent orders addressing relocation within Uttar Pradesh were already under scrutiny.

Senior Advocate Mehmood Pracha submitted that the petitioner had approached the Supreme Court due to jurisdictional limitations faced before the High Court in seeking relocation outside the state.

Emphasising judicial propriety, the Court held that it would not be appropriate to adjudicate issues currently pending before the High Court. The Supreme Court accordingly disposed of the petition and requested the High Court to take up the matter expeditiously and pass orders in accordance with law.
