Filed by advocate Syed Mohammad Haider Rizvi, the applications allege that at least 236 undertrial prisoners across Uttar Pradesh remain in custody despite being granted bail, primarily because they are unable to arrange sureties or meet monetary conditions. The applicant relies on information obtained under the Right to Information Act from district jails and alleges non-compliance with the Supreme Court’s directions issued on January 31, 2023, to facilitate the release of prisoners who remain incarcerated after being granted bail.
The applicant has sought directions for the release of these prisoners on personal bonds or on relaxed surety and monetary conditions, as appropriate, and has alleged that the State’s legal services authorities have failed to take adequate steps to secure their release.
