US DOJ Moves To Dismiss Criminal Indictment Against Gautam Adani, Sagar Adani And Others

In a major development in the US proceedings involving the Adani Group, the United States Department of Justice has moved before Judge Nicholas G. Garaufis of the United States District Court for the Eastern District of New York seeking dismissal with prejudice of the criminal indictment against Gautam Adani, Sagar Adani, and other accused persons.

In a motion dated May 18, 2026, the DOJ stated that, after reviewing the matter, it had decided in the exercise of prosecutorial discretion not to devote further resources to pursuing the criminal charges against the individual defendants. The request has been made under Rule 48(a) of the Federal Rules of Criminal Procedure.

The DOJ informed the court that while no defendant has formally appeared in the proceedings, counsel for all defendants have consented to the relief sought.

A proposed order placed before Judge Garaufis seeks dismissal of the indictment with prejudice, which would bring the criminal prosecution to a close and prevent revival of the same charges.
