The Allahabad High Court has directed that CJP Activist Gaurav Bharti @ Gaurav Kumar shall not be arrested in connection with an FIR registered after he allegedly recorded and circulated a video highlighting the condition of a government primary school in Farrukhabad, Uttar Pradesh.
A Bench of Justice Salil Kumar Rai and Justice Padam Narain Mishra was hearing Bharti’s Criminal Misc. Writ Petition challenging an FIR registered on August 19 at Nawabganj Police Station, Fatehgarh, under Sections 352 and 353 of the Bharatiya Nyaya Sanhita, 2023 and Section 66 of the Information Technology Act, 2000.
According to the FIR, Bharti had allegedly illegally prepared a video of the institution and misrepresented its condition. Bharti, however, contended that the allegations were false and the FIR could not be sustained in view of an earlier Division Bench judgment dated September 8, 2026. Bharti had reportedly recorded the video as part of the CJP’s “School Thik Karo” campaign, which seeks to highlight problems concerning government schools.
The High Court observed that the matter required consideration, issued notice to respondent no. 4 and granted the respondents eight weeks to file their counter-affidavit, with four weeks thereafter for the petitioner to file a rejoinder.
Meanwhile, the Court ordered that Bharti shall not be arrested pursuant to the FIR.
