The Bombay High Court has held that employees of Navi Mumbai Municipal Corporation are not State Government employees, and therefore they cannot claim the benefit of the age exemption available to “Government Servants” under the Bombay Civil Services Rules, 1939 or Rule 10 of the Maharashtra Civil Services (General Conditions of Services) Rules, 1981. Recruitment to NMMC posts is governed by the NMMC Service Rules, 2021, which the Court treated as the applicable and self-contained framework for age limits in such recruitment.
The Court also held that the NMMC advertisement dated 13 December 2025 was valid even though it did not incorporate the exemption claimed by the petitioners under the State Government service rules. Since the petitioners were governed by the NMMC Service Rules, 2021 and not by the 1939/1981 rules in the manner contended, their challenge to the advertisement had no merit. The High Court accordingly held that the petitioners were bound by the conditions set out in the NMMC advertisement dated 13 December 2025. It found no illegality in the advertisement and declined to grant any direction for upper age relaxation in favour of the petitioners.
The Division Bench comprising Justice G. S. Kulkarni and Justice Aarti Sathe noted that, in an earlier interim order dated 17 February 2026, it had specifically asked the State to clarify whether the 1939 Rules and the exemption in Note 3B were still in force. After considering the State’s subsequent affidavit, the Court recorded that the State had categorically clarified that the 1939 Rules and the age relaxation claimed by the petitioners did not apply to them, and that municipal corporation employees are not State Government employees.
The Court then examined Rule 5.4 of the NMMC Service Rules, 2021 and found that the NMMC rules themselves are a self-sufficient code on age limits for appointments by nomination. Importantly, the Court reproduced the official translation of Rule 5.4, which states that the maximum age limit shall not apply to employees appointed to government-approved posts in NMMC through the prescribed procedure. Even so, the Court rejected the petitioners’ attempt to read into the recruitment process the exemption available to government servants under the 1981 Rules, holding that such reading was erroneous because NMMC appointments are governed by the NMMC Service Rules, 2021.
The Court further observed that the advertisement dated 13 December 2025 was issued by NMMC and was therefore governed by the NMMC Service Rules, 2021. Since NMMC employees are no longer covered as government servants for this purpose, the petitioners had to comply with the recruitment conditions contained in the advertisement itself.

Briefly, the petition was filed seeking upper age relaxation for the post of Assistant Commissioner under an NMMC recruitment advertisement dated 13 December 2025. They argued that as serving government employees, they were entitled to exemption from the upper age limit under Note 3B to Rule 7 of the Bombay Civil Services (Classification and Recruitment) Rules, 1939, read with Rule 10 of the Maharashtra Civil Services (General Conditions of Services) Rules, 1981, and the Government Resolution dated 25 April 2016. They also challenged the advertisement on the ground that it did not incorporate the clause exempting government servants from the upper age limit.
The petitioners pointed out that the 1939 Rules contained an exception that no upper age limit would apply to government servants, that this position was preserved under the 1959 Rules and later under Rule 10 of the 1981 Rules, and that subsequent Government Resolutions under the 1986 Rules only enhanced age limits for candidates other than government servants. They also relied on Rule 5.4 of the Navi Mumbai Municipal Corporation Services Rules, 2021, which says that the maximum age limit for appointments by nomination would be as per prevailing Government of Maharashtra rules and GRs.
The factual trigger for the dispute was that NMMC issued its recruitment advertisement on 13 December 2025 for posts including Assistant Commissioner, but did not mention any exemption from the upper age limit in favour of government servants. The application timeline was later extended, and the petitioners approached the High Court contending that the omission was contrary to the applicable service rules.
