Bombay HC to Conduct Contempt Proceedings over ‘Wholly Inappropriate’ Behaviour of Litigant After Appointment of Court Receiver to Take Possession of Property

Harjit Kaur Onkar Singh Kalra v. Rose Venkateshan [Decided on 27-10-2026]

A contempt petition was filed in a review petition over an eviction dispute before the Bombay High Court, wherein a Single Judge Bench of Justice Madhav J. Jamdar took note of the respondents’ improper conduct amounting to contempt of court and ordered the contempt petition to be heard on 30-10-2026.

The respondents were personally present before the Court and stated that they were in possession of the subject property, which they would hand over to the petitioners on 29-10-2026. However, the Court found the facts of the case to be shocking since a suit was filed in 2009 by the petitioners (landlord) against gratuitous licensee, which was decreed by a judgment and decree on 06-07-2018. The decree was then challenged in an appeal which was dismissed on 04-10-2021. Thereafter, a civil revision application challenging the same was also dismissed by a Single Judge on 23-07-2024 and the applicants were granted eight weeks to vacate the premises.

Subsequently, a review petition was filed and dismissed by a Single Judge on 07-10-2024. On 17-04-2025, the said decree was executed and thereafter, again the respondents entered into possession of the subject property. Hence, the Court was satisfied that the respondents’ conduct amounted to interference in the administration of justice.

The Court appointed the Court Receiver, Bombay High Court, to take symbolical possession of the subject property by 28-10-2026 and directed him to remain present at 7 PM on 29-10-2026 when the respondents hand over possession to the petitioners. The Court Receiver was directed to take physical possession of the subject premises and hand over the same to the petitioners in case the respondents fail to hand over the same and also permitted police protection for the said purpose.

Further, the Court noted that respondent 4 had behaved in an inappropriate manner, amounting to contempt of court. Hence, the Court directed the contempt petition to stand over to 30-10-2026 for a hearing on the conduct of the respondents. All respondents were directed to remain present on the next date.
