‘It’s a Very Serious Matter’: CJI Surya Kant Assures Immediate Attention of Claim That Registry Misplaced Case File

The Supreme Court on Wednesday took serious note of a submission that an file of plea to urgently list anticipatory bail had allegedly been misplaced by the Registry and remained neither registered nor listed despite repeated requests. The issue arose during mentioning before a Bench comprising Chief Justice of India Surya Kant and Justice V. Mohana.

Advocate Subhi Shivani Jaideep informed the Court that the lising application had been filed on June 8, 2026. However, despite the passage of several days, the matter had neither been searched nor registered by the Registry. It was further submitted that the Advocate-on-Record had addressed a written representation to the Registrar on June 16 seeking urgent registration and listing of the matter.

According to counsel, the case file appeared to have been misplaced at the Registry’s end. Seeking intervention, counsel requested the Court to direct the Registry to immediately trace the file, register the petition and place it for urgent listing. Reacting to the submission, CJI Surya Kant remarked:

“It’s a very serious matter if the Registry has misplaced the file.”

The Bench sought to ascertain whether any explanation had been received from the Registry. Counsel informed the Court that no response had yet been received despite the written representation. Taking a proactive approach, the Chief Justice asked the Advocate-on-Record to immediately place the complaint before him.

“Ask your AOR to give a complaint to me right now during the day. I am very much available. They can give me complaint in chamber, they can give me complaint at my residence. Give me the full details.”

The Court then sought particulars of the matter, following which counsel informed the Bench that the case was Diary No. 35830 of 2026, Tejinder Kaur Mathura v. State of Punjab & Anr.
