Delhi HC Allows Challenge to NAREDCO Governing Council Dispute to Proceed

NAREDCO Governing Council Dispute

The Delhi High Court has dismissed an application under Order VII Rule 11 CPC filed in the dispute concerning the Governing Council of the National Real Estate Development Council (NAREDCO), allowing the petitioners’ challenge to proceed.

The respondents had sought rejection of the petition at the threshold by invoking Order VII Rule 11, which permits rejection of a plaint in specified circumstances, including where it does not disclose a cause of action or is barred by law.

By dismissing the application, the Court has declined to terminate the petitioners’ proceedings at the preliminary stage. The substantive challenge raised by the petitioners will therefore continue before the Court.

The dispute concerns the constitution and appointments to NAREDCO’s Governing Council, with the petitioners questioning the validity of the process adopted in relation to the Council.
