The Delhi High Court on Friday issued notice on the bail appeal filed by Sharjeel Imam in a UAPA case in connection with Delhi Riots Conspiracy and sought a response from the respondents within two weeks.
A Bench of Justice Prathiba M Singh and Justice Vikas Mahajan was hearing Imam’s appeal challenging the rejection of his bail by the trial court.
It was submitted that the trial court had failed to appreciate the liberty granted by the Supreme Court in its earlier judgment and relied upon subsequent decisions, including Tahawwur Rana and Tasleem, to contend that prolonged incarceration without commencement of trial warranted consideration of bail. Counsel further pointed out that charges are yet to be framed, despite Imam having remained in custody for over six-and-a-half years.
Opposing the plea, Additional Solicitor General S.V. Raju submitted that considerable time had already been spent at the stage of hearing on charge, noting that the proceedings had taken over 200 days because of the large number of accused in the case.
Taking note of the submissions, the Bench issued notice and directed the respondents to file their reply within two weeks, with rejoinder, if any, to be filed within a further two weeks. When counsel for Imam requested an early hearing, citing the prolonged incarceration, the Court agreed to list the matter on August 27, 2026.
Before concluding the hearing, the Chief Justice also remarked to the ASG:

“Mr. Raju, whoever has to argue, please appear physically, because in such matters, you can’t do online.”
The matter will now be heard on August 27, 2026.
