Delhi High Court Directs Gymkhana Club Estate Officer Not to Pass Final Eviction Order Until Next Hearing

Vipin Aggarwal v. Union of India, Decided on 16.10.2026

Delhi High Court Gymkhana Eviction

The Delhi High Court has directed the Estate Officer to continue proceedings under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, but not to pass a final order until the next date of hearing in a petition filed by Vipin Aggarwal and others.

Justice Amit Mahajan passed the direction on October 16, 2026, while hearing a petition against the Union of India and others. The petitioners apprehended that the Estate Officer, whose proceedings were listed for hearing submissions on October 22, 2026, might pass a final order, rendering their pending petition infructuous.

The Central Government Standing Counsel submitted that the matter was listed for further proceedings and arguments, and that no final order was likely to be passed on October 22. In view of this submission, the Court listed the applications along with the main petition on November 17, 2026, and directed the parties not to seek unwarranted adjournments in the proceedings before the Estate Officer.
