Court on its own motion v. State of Jharkhand [Decided on 22-05-2026]

Jharkhand High Court

A Public Interest Litigation (PIL) was registered before the Jharkhand High Court regarding the sexual exploitation of a female inmate of Birsa Munda Central Jail, Hotwar, by the Superintendent of Jail, which was heard by a Division Bench of Justice Rongon Mukhopadhyay and Justice Pradeep Kumar Srivastava.

It was stated that the said sexual exploitation resulted in the female inmate becoming pregnant, and attempts were made to terminate the foetus. The reports stated that the perpetrator of the offence and senior officials were trying to hush up the incident.

The Court stated that the issue of such magnitude, wherein the custodians of the inmates’ welfare had been alleged to have become the predator, needed a proper and detailed response from the State as to what steps were taken to verify the truthfulness of the allegations.

Thus, the Court directed that an affidavit be sworn by the Director General of Police and filed within 2 weeks.

The matter is now listed on 08-06-2026.
