Lady Advocate Submits Representation Before Chief Justice of MP HC against Justice GS Ahluwalia Over Improper Remarks

A representation has been submitted before the Chief Justice of the Madhya Pradesh High Court, raising serious concerns over the denial of anticipatory bail and alleged inappropriate remarks made during proceedings by Justice Gurpal Singh Ahluwalia.

The representation, filed by Advocate Dolly Soni, arises out of an anticipatory bail application moved on behalf of Vijay Shankar Kanakne in connection with an FIR under Section 108 of the Bharatiya Nyaya Sanhita.

According to the representation, the applicant sought parity with co-accused persons who had already been granted anticipatory bail by a coordinate Bench. However, the matter allegedly took a different turn before the concerned Bench. The representation claims that:

“The case was dismissed mechanically, without due consideration of parity. Certain personal remarks were made against the undersigned counsel, which were not warranted in judicial proceedings.”

The counsel has stated that despite having a strong case on merits, the applicant was compelled to withdraw the bail application. The representation also raises concerns over remarks directed at a woman advocate, stating:

“Any unwarranted personal remarks against a member of the Bar, especially a lady advocate, adversely affects the dignity of the legal profession.”

The petitioner has urged the Chief Justice to take administrative cognisance of the issue, ensure uniformity in judicial orders, particularly in matters involving parity, and take appropriate steps to maintain the dignity of court proceedings and the Bar.
