NHRC Issues Conditional Summons to Authorities After Students Forced to Walk 14 Kms through Dense Forest in Absence of Road Connectivity

A complaint was filed before the National Human Rights Commission (NHRC) advancing arguments regarding the imminent danger to the lives of students belonging to more than 50 schools and colleges in Pachedoddi village, Hanur Taluk, Karnataka, as they are compelled to walk 14 kms daily through dense forest patches, treacherous roads, as well as a region wherein tiger movements and sightings have been recently confirmed.

It was asserted that the village had no bus connectivity, motorable roads, or transportation infrastructure and that the State had failed to provide even minimum safety for children to access education. Violation of constitutional guarantees mandated by Articles 21, 21-A, and 39(f) were also alleged.

By proceedings dated 23-12-2025, a Bench presided by Priyank Kanoongo (Member) took cognizance in the matter and directed the Principal Secretary, Department of Primary and Secondary Education, Karnataka, Bangalore, and the District Magistrate to inquire about the allegations and submit an Action Taken Report within two weeks.

NHRC referred to the Supreme Court’s decision in Manager Palthingal MLP School, Parappanangadiv v. Sethumadhavan PK and Ors. (Civil Appeal No. 11359 of 2017) and noted that if the allegations are found to be true, it would amount to a violation of fundamental rights. It was stated that despite seriousness of the allegations and repeated directions, the authorities concerned had failed to submit the required reports.

Taking serious view of this, NHRC directed the issuance of Conditional Summons to the authorities concerned under Section 13 of the Protection of Human Rights Act, 1993 for appearance in person or through a duly authorized representative on 15-07-2026, along with the enquiry report. However, the Court stated that if the reports are received on or before 01-07-2026, the personal appearance of the authorities would be dispensed with.
