Punjab & Haryana HC Directs Balwant Singh Rajoana to Be Taken to PGIMER Chandigarh for Eye Treatment

The Punjab and Haryana High Court has disposed of a petition filed by Balwant Singh Rajoana, directing that he be taken immediately to the Department of Ophthalmology at PGIMER, Chandigarh and provided appropriate treatment for his eye condition.

Justice Jasjit Singh Bedi was hearing Rajoana’s petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS)/Section 482 CrPC, seeking permission to undergo an eye operation at Dr. R.S. Randhawa Eye Hospital, Patiala, at his own expense. The petition related to the case arising from FIR No. 9 dated August 31, 1995.

The petition stated that he had developed increasing difficulty with his eyes during his more than three decades in custody and had been advised regarding cataract treatment. The medical opinion placed on record indicated that the cataract condition in both eyes was similar to the previous visit, while he was also experiencing increasing irritation when wearing his prescribed glasses.

During the hearing, Sr Adv P.S. Hundal representing Balwant Singh fairly conceded that he would have no grievance if he was examined and provided appropriate treatment at PGIMER, Chandigarh. The counsel appearing for the Union of India and the Chandigarh Administration accordingly submitted that Balwant Singh Rajoana would be taken immediately to PGIMER’s Department of Ophthalmology and provided adequate treatment.

In view of the assurance, the Court held that no further orders were required and disposed of the petition.
