Rajasthan High Court Directs State to Frame Comprehensive Transfer Policy Within Two Months

The Rajasthan High Court has issued a series of directions to streamline the process of employee transfers and reduce litigation arising from transfer orders. The Court comprising of Justice Sameer Jain held that while employees do not have a vested right to remain posted at a particular station, transfer powers must be exercised in accordance with the applicable policy, statutory framework and principles of fairness.

The directions came in a batch of writ petitions challenging transfer orders on grounds including violation of transfer policy, failure to consider individual circumstances, premature or repeated transfers and allegations of mala fide or extraneous considerations.

The Court directed employees aggrieved by their transfers to submit comprehensive representations before the competent authority within 15 days. The representations are to be considered and decided within a further 15 days, with the decision required to record brief and intelligible reasons.

The Court also directed the departments concerned and establishments to constitute Departmental Transfer Grievance Committees within seven working days to examine such grievances.

At the State level, the Court directed constitution of a committee comprising Justice Alok Sharma (Former Judge), the Advocate General for Rajasthan and the Chief Secretary to formulate a comprehensive transfer policy for the State and place it before the competent Government within two months.

The Court further issued directions concerning the functioning of the Rajasthan Civil Services Appellate Tribunal (RCSAT) and emphasised the need for an effective institutional mechanism for resolving transfer-related grievances.

The Court clarified that its directions do not curtail the State’s legitimate power to transfer employees and do not confer any right upon an employee to remain at a particular posting. The batch of writ petitions was accordingly disposed of.
