An application was filed on behalf of the State before the Rajasthan High Court seeking vacation of an order dated 18-08-2015 and 20-08-2015 whereby security protection was provided to the then Public Prosecutor due to security threat received by him in connection with the discharge of his professional duties.
The State submitted that the statement of the protected person had already been recorded before the criminal court concerned, and that as per the intelligence report, there was no sufficient justification for continuation of the security provided to him in 2015.
A Single Judge Bench of Justice Pramil Kumar Mathur noted that the criminal trial had not been concluded and that the final adjudication was still pending. It was said that the fact that the then Public Prosecutor had been examined, may be a relevant consideration while assessing the threat perceptions, but it could not, by itself, constitute a ground for withdrawal of the security.
Even though the police reports mentioned that no direct or indirect threat had been received by the protected person after 2015, the Court held that the circumstances did not warrant immediate withdrawal of the security arrangement. Thus, the application was rejected.
