‘Let State Be Run by Political Executive, Not Court’: SC on Plea for Central Force Deployment Post-Election in WB

The Supreme Court on Monday refrained from entertaining an urgent mentioning seeking continued deployment of central police forces to address alleged post-poll violence, advising the petitioner to approach the High Court.

Senior advocate V. V. Giri, appearing for the petitioner, submitted that similar situations in the past had seen widespread violence. He stressed the need for the continuation of central forces even after the conclusion of elections.

Senior advocate Dama Seshadri Naidu, appearing for ECI, has submitted that the role of authorities overseeing elections ends once the electoral process is over.

Justice Joymalya Bagchi observed that decisions relating to law and order fall within the domain of the political executive. “Let the state be run by the political executive and not the court,” he said. The Chief Justice Surya Kant questioned the urgency of the matter, indicating that appropriate remedies could be pursued before the High Court.

The plea also sought the constitution of a monitoring committee under a former Supreme Court judge to oversee the situation. The bench posted the matter for May 11.
