Supreme Court Declines to Transfer Plea Challenging Judicial Officer’s Removal Despite Claim of Multiple Recusals

“I would like to know who are the judges. So then I am going to make an inquiry that what kind of activities you are indulging in.”

The Bench of Chief Justice Surya Kant and Justice V Mohana was not persuaded that the circumstances warranted transfer of the proceedings. Instead, the Court indicated that the matter should proceed before a duly constituted Division Bench of the High Court and cautioned against attempts that could impede the adjudicatory process.

The Court observed that if any effort was made to create obstacles in the hearing of the case, serious consequences could follow. It further assured the petitioner that the proceedings would be monitored.

Declining the transfer request, the Supreme Court directed that the matter be heard on a day-to-day basis by the High Court. The Bench also directed that after the hearing is concluded and judgment is reserved, a compliance report be forwarded to the Supreme Court.
