The Supreme Court on October 13, 2025, highlighted the widespread non-compliance by States and Union Territories with its earlier order dated 05.09.2025, which had directed them to establish standards for safety measures in Intensive Care Units (ICUs) in hospitals. Justices Ahsanuddin Amanullah and N.K. Singh, noting the failure to comply with this directive, issued strict instructions to the top health officials and the Court-appointed Committee, emphasizing that no excuses, including prior engagements, would be accepted, and any such commitments must be rescheduled to prioritize compliance with the Court’s orders.
The Court noted that on the previous occasion, all States and Union Territories had failed to comply with its directions to conduct a specified health exercise and submit detailed health department compliance reports to the three-member Committee constituted by the Court by order dated 19.08.2025. The States were required to submit the detailed health report to the Additional Solicitor General by 05.10.2025.However, despite indulgence and repeated timelines, most States had either not submitted the reports at all or submitted them after the fixed date of 05.10.2025 reflecting a causal approach towards the Court’s orders.
The Court addressing the matter issued notices to the Additional Chief Secretaries or the senior-most officials of the Health Departments of all States and UTs, directing them to appear personally before the Court with affirmed show-cause affidavits explaining the failure to comply. The Court also highlighted the role of the three-member Committee, including court appointed Dr. Nitish Naik, requesting that they meet at least once a week to review the available material and prepare comprehensive reports reflecting compliance by the States and UTs. The Court further instructed that any continued non-compliance, casual submission, or perfunctory reporting would attract strict action against both the officers concerned and the respective States and UTs. Accordingly, the matter is listed on November 20, 2025 to ensure urgent attention.
