Supreme Court Dismisses Flipkart’s Plea In MARQ Trademark Dispute; Grants 8 Weeks To Liquidate Existing Stock

The Supreme Court dismissed Flipkart’s challenge to orders restraining it from using the trademark MARQ, while granting the e-commerce company eight weeks to liquidate its existing stock bearing the mark.

Flipkart had approached the Court after suffering adverse orders before both the trial court and the High Court in the trademark dispute concerning use of the MARQ branding.

Senior Advocates Mukul Rohatgi and Rajshekhar Rao appeared for Flipkart, while Senior Advocate Akhil Sibal represented MARC Enterprises.

During the hearing, the Court declined to interfere with the injunction orders operating against Flipkart, effectively affirming the restraint on continued use of the disputed mark.

However, taking note of submissions regarding existing inventory, the Court permitted Flipkart a limited eight-week window to exhaust stock already in circulation, instead of requiring an immediate halt.
