In a criminal appeal filed before the Supreme Court of India against a judgment and order dated 12-12-2024 by the High Court of Telangana, a Bench comprising Justice M.M. Sundresh and Justice Prasanna B. Varale suspended the appellant’s sentence and granted him bail during the pendency of the appeal.
The appellant was convicted and sentenced to undergo life imprisonment for committing murder punishable under Section 302 of the Indian Penal Code, 1860 (IPC) by the trial court. By the impugned judgment and order, the Telangana High Court dismissed the appeal while upholding the trial court’s order. Aggrieved, the present appeal was filed.
The Court noted that the appellant had undergone more than 11 years out of the actual sentence awarded and that the appeal was likely to take a considerable period to conclude. Considering the period of incarceration and the pendency of the appeal, the Court opined that the appellant’s continued incarceration was not required.
Hence, the Court suspended the sentence imposed on the appellant and granted him bail during the pendency of the appeal, subject to terms and conditions imposed by the trial court. The appeal was directed to be listed in its usual course.
