Calcutta HC Requests Tribunal To Consider Appeal Against Voter List Deletion Amid Poll Urgency

Golam Mohiuddin v. Election Commission of India, Decided on 17.04.2026

Voter list deletion appeal urgency

The Calcutta High Court disposed of a writ petition seeking urgent consideration of an appeal against deletion of the petitioner’s name from the electoral roll, directing the Appellate Tribunal to take an appropriate decision in accordance with law at the earliest.

The petitioner had challenged a deletion list dated April 5, 2026, and filed an appeal before the designated Appellate Tribunal on April 9, 2026. It was contended that the petitioner’s voting date was scheduled for April 23, 2026, and unless the appeal was decided urgently, the petitioner would be deprived of exercising the right to vote.

Counsel for the petitioner relied on a recent Supreme Court order dated April 13, 2026, wherein the Election Commission of India was directed that wherever appellate tribunals decide such appeals within the stipulated timelines (April 21 or April 27, 2026), the outcomes must be implemented through supplementary revised electoral rolls, enabling affected individuals to vote.

Taking note of the submissions and the fact that notice had been served on the respondents, who remained unrepresented, Justice Krishna Rao declined to enter into the merits and instead disposed of the petition by requesting the Tribunal to consider the appeal in accordance with law.
