The Delhi High Court has stayed the operation of the BCD’s order suspending former Delhi High Court Bar Association (DHCBA) President Rajiv Khosla and advocates Aarti Tyagi, Anju Dixit and Shaheen Mansoori from the rolls of the Bar Council over allegations of misbehaviour with Justice Talwant Singh during the election counting process. The Court also stayed the direction restraining the four advocates from entering the precincts of the Delhi High Court.
Justice Amit Bansal granted interim relief while hearing petitions challenging the BCD’s order dated April 26, which had suspended the advocates for allegedly “manhandling, pushing and abusing” officials entrusted with conducting the Bar Council elections. The suspension order was passed following allegations that the advocates had obstructed election officials during the counting process
The petitioners contended that the disciplinary action, including their suspension from the Bar Council rolls and the prohibition on entering the Delhi High Court premises, was legally unsustainable. Accepting their plea for interim protection, the High Court stayed the operation of the impugned order as well as the entry restriction until further orders.
The matter has now been listed for further hearing in October, when the Court will examine the legality of the disciplinary action initiated by the Bar Council of Delhi.
