The Supreme Court has declined to cancel the bail granted to an accused in a criminal case involving charges under Sections 302, 364, 201, and 120B of the IPC. The petitioner, a de-facto complainant, had challenged the Allahabad High Court’s order granting bail to the accused.
A bench comprising Justice J.B. Pardiwala and Justice Vijay Bishnoi noted prima facie concerns that the accused had attempted to tamper with prosecution evidence during the trial, with additional FIRs reportedly filed on such allegations. However, the Court observed: “Be that as it may, it is too late in the day now to cancel the bail as the trial is at the fag end.”
Instead of interfering with the bail order, the Court directed the trial court to conclude proceedings and deliver judgment within three months. It also instructed the State to take appropriate legal action regarding allegations of witness harassment and evidence tampering.
The Special Leave Petition was accordingly disposed of.
