The Court identified the proviso to Rule 7 of the Entitlement Rules 2008 as the sole material departure from the 1982 regime. Where a claim is preferred after 15 years of discharge, retirement, invalidment, or release, the burden shifts to the claimant to prove entitlement. The Court reiterated that the opinion of a duly constituted Medical Board, being an expert determination on medical causation, must be given due deference. Judicial interference is warranted only where there is a clear defect, such as absence of reasons, failure to consider germane material, or manifest error, and ordinarily such defect should result in reconsideration by the medical authority rather than substitution by the court.
The Court also clarified that the binding decision in Dharamvir Singh v. Union of India [(2013) 7 SCC 316] was rendered in the context of the Entitlement Rules 1982, and its principles cannot be mechanically transplanted to cases governed by the Entitlement Rules 2008 without examining the changed framework and the specific factual matrix.
The Court noted that there was a great amount of uncertainty about the very existence and legal validity of the Entitlement Rules 2008, an enquiry which had eluded the Court on more than one occasion. The Court placed significant reliance on the Raksha Mantri Report, 2015, which explicitly observed that the ‘Pension Regulations 2008’ and ‘Entitlement Rules 2010’ have no sanctity of law and are not validly issued documents, having been brought in by a ‘sleight of hand’ without Cabinet approval, without the approval of the Department of Pension and Pensioner’s Welfare (DoPPW), and without stakeholder consultation.
The Court further noted that under the Allocation of Business Rules, 1961, the Department of Ex-Servicemen Welfare (DESW) is only allocated the administration of the four existing regulations, and has no power to formulate, amend, or issue a fresh instrument in their place.
The Court then conducted a detailed comparative analysis between the Entitlement Rules 1982 and the Entitlement Rules 2008 across five key subjects: presumption at entry, causal connection, onus of proof, aggravation, and the position when the cause of disability is unknown.
The Court observed that while Rule 5 of the Entitlement Rules 2008 withdraws the automatic presumption of sound condition at entry and adds a causal connection requirement, the other beneficial provisions broadly remain untouched. Rule 7 of the Entitlement Rules 2008 continues to place the onus of proof on the employer, subject only to a narrow proviso for claims made after 15 years. Rule 11 of the Entitlement Rules 2008 reproduces the identical aggravation scheme from Rule 20 of the Entitlement Rules 1982, and Rule 10(b)(iii) parallels Rule 20(a) regarding cases where the cause of disease is unknown.

Briefly, the Apex Court was confronted with a large batch of Special Leave Petitions filed by the Union of India, all arising from disability pension claims of ex-servicemen. In each of these cases, the Release Medical Board (RMB) had, at the first instance of assessment, opined that the disability was ‘Neither Attributable Nor Aggravated’ (NANA) by military service. Relying on the Medical Board’s opinion, the intra-departmental appeals of the ex-servicemen were also dismissed.
The ex-servicemen then approached the Armed Forces Tribunal (AFT) or the High Courts, which interfered and granted disability pension on the premise that the disability was either attributable or aggravated (A/A) by military service. The Union’s present appeals challenged both the AFT orders, and the High Court orders which confirmed them. The controversy was confined to the entitlement to the disability element of service pension upon retirement, i.e., upon normal completion of service or engagement, and not to cases of medical invalidity.
