The Supreme Court dismissed Dabur’s appeal against the injunction order passed by the Delhi High Court. However, by consent of all counsels extends Time for Exhausting Existing Stock Till end of November provided No Further Extension to Be Granted and strict compliance with High Court order on recall of goods after time period ends.
The Supreme Court bench of Justice P.S. Narasimha and Justice Alok Aradhe, hearing the dispute between Dabur and Emami, has dismissed the appeal but with consent of parties extended by two months the time granted to exhaust existing stocks of the products covered by the interim injunction provided stocks are recalled and High Court order is complied with strictly.
Senior Advocate Niranjan Reddy appeared for Dabur ( Petitioners) and pleaded that the condition to recall the goods should be modified as Dabur cannot recall goods once sold.
Senior Advocate Abhimanyu Bhandari, appearing for Emami (Defendant) opposed this saying without the condition to recall goods there will be dilution of the injunction order and that while some more time can be granted goods have to be recalled once time expires.
Reliance was placed on an earlier judgment in Amaron v. Exide Batteries, IP-COM/18/2025, where the Court had modified an interim injunction to permit third-party distributors and retailers to sell existing stock by the Petitioners.
The Court noted that the Single Judge had earlier granted time for exhausting the existing stock, with the period subsequently extended. It extended the period by a further two months from September 25, 2026, effectively permitting the existing stock to be exhausted until end November.
The Court made it clear that no further extension would be granted, while continuing the other conditions imposed under the earlier orders.
