Delhi Court Allows NEET-UG 2026 Paper Leak Accused Yash Yadav to Appear for Re-Examination

The Rouse Avenue Court has permitted Yash Yadav, an accused in the NEET-UG 2026 paper leak case, to appear for the re-examination scheduled to be held on June 21, while continuing to remain in judicial custody.

The order came on an application moved by the accused seeking permission to take the re-test following the cancellation of the original NEET-UG examination amid allegations of a paper leak. The accused had earlier approached the court seeking interim relief after it emerged that he would be eligible to sit for the re-examination being conducted by the National Testing Agency (NTA).

While granting the relief, Special Judge (CBI) Ajay Gupta observed that access to education is a fundamental right and an accused person cannot be denied the opportunity to pursue education solely because criminal proceedings are pending against him. The court noted that the accused continues to enjoy the presumption of innocence until proven guilty and that participation in the examination would not prejudice the ongoing investigation.

Background of the case

The accused was arrested nearly a month ago in connection with the alleged NEET-UG paper leak, which prompted the cancellation of the examination and led to a nationwide re-test for lakhs of candidates. Investigating agencies have alleged that several individuals were involved in facilitating access to examination material before the test. The probe remains ongoing.

The issue had previously come before the court when he sought interim bail to enable him to appear for the re-examination. At that stage, the court had described the request as premature in the absence of clarity regarding the issuance of an admit card and other examination-related formalities. Subsequently, after considering the circumstances and the scheduled re-test, the court allowed him to appear in the examination.

The NEET-UG re-examination is scheduled for June 21, following the cancellation of the original examination over allegations of question paper leakage.
