Delhi High Court Protects Jamia Millia Islamia School Employees From Termination; Issues Notice

The Delhi High Court on Wednesday has granted interim protection to employees working in schools run by Jamia Millia Islamia University, directing that their services shall not be discontinued till the next date of hearing.

Justice Tejas Karia was hearing a petition filed by several teachers who have sought regularisation of their services and expressed apprehension that they may be removed from service pending adjudication of their claims. Counsel for the petitioners submitted that similarly placed employees in other Jamia-run schools had already secured interim protection from the Court. Relying on those orders, it was argued that the petitioners faced a genuine threat of termination and should be granted similar relief.

Appearing for Jamia Millia Islamia, counsel opposed the plea and submitted that the schools were operating under a self-financing model. It was argued that the petitioners were not working against substantive sanctioned posts and that their engagements were renewed from academic session to academic session. The University further contended that no notification proposing termination of the petitioners had been issued.

When the Court sought clarity on whether the University intended to discontinue the services of the petitioners, the University’s counsel responded that there was no notification on record indicating any proposed termination and sought time to obtain instructions.

The Court, however, noted the petitioners’ apprehensions and the fact that they had been continuing in service for several years. After hearing the parties, the Court issued notice and recorded the respondents’ statement that there was presently no likelihood of termination.

Taking note of the circumstances, Justice Karia directed that the services of the petitioners shall not be discontinued till the next date of hearing.

The matter has been listed for further hearing on August 10, 2026.
